Australian presents submission to the International Criminal Court.

The Zionist Federation of Australia (ZFA), Zionist Council of New South Wales (ZCNSW) and the Australia/Israel  & Jewish Affairs Council (AIJAC) today all highly praised the fact that Australia has opposed a bid by the International Criminal Court (ICC) to investigate alleged war crimes in the Palestinian Territories.

The Jewish leadership strongly commends Australia’s principled and legally justified decision to make a submission in favour of Israel before the International Criminal Court (ICC) over vexatious and baseless Palestinian allegations of war crimes.

Australia does not recognise the ‘State of Palestine’ and does not have any relationship with the ‘State of Palestine’ under the Rome Statute”, the establishing document of the ICC, to which Australia is a signatory, according to court documents filed by the Australian Government,

Australia with at least Germany, Czech Republic, Hungary and Austria, to make similar submissions, on the basis that ICC does not have the requisite jurisdiction to hear the matter because ‘Palestine’ is not a state under international law.

The Palestinian action before the International Criminal Court, which is entirely without any legal merit, is no more than a campaign of ‘lawfare’, seeking to abuse and weaponize international law for political means. Not only are the Israel Defense Forces one of the most moral armies in the world, acting fully in accordance with international law, Israel also has a free, fair and vigorously independent judicial system and Rule of Law.

Moreover, notwithstanding that the Palestinians have joined the ICC’s Rome Statue, ‘Palestine’ does not meet the criteria for statehood under international law, therefore failing to pass the necessary threshold to even commence an action before the ICC.

In December last year, when the ICC signalled an intention to commence investigations, the Department of Foreign Affairs and Trade (DFAT) said “Australia’s position is clear – we do not recognise a so-called ‘State of Palestine’ and we do not recognise that there is such a State Party to the ICC’s Rome Statute”, adding it considers that “the question of territory and borders can be resolved only through direct negotiations between Israel and the Palestinians. This is the only way to ensure a durable and resilient peace.”

Once again, the Morrison government has shown its unwavering solidarity with Israel and commitment to fighting anti-Israel bias on the international stage, in both word and deed.

Jewish leaders would like other countries to follow Australia’s responsible lead, in order to uphold the principles of international law and avoid the Palestinians’ egregious attempts to politicize the Court and undermine the very foundation of the international law framework.’

    They are not “Palestinian territories.”
    The Arabs who call themselves “Palestinians” regard all of Israel as “Palestinian territories.”
    They are Jewish territories which are claimed by Arabs who call themselves “Palestinians.”
